Purchasing Products & Services
Appointment fees are as outline on the website and are current at the time of booking. Payment is due at the time of booking. By placing an order via the Website, you are offering to purchase Products and/or Services (as applicable) from Desi Karandaglidis subject to these Terms and Conditions. Each Order you place will be a separate and binding contractual agreement between you and Desi Karandaglidis and with respect to the supply of the Products and/or Services in accordance with these Terms and Conditions. You agree that Desi Karandaglidis reserves the right in its sole discretion to accept or reject an Order, and that Orders are subject to availability of the relevant Products and/or Services.
All prices are quoted in AUD and are subject to change without further notice.
All prices are inclusive of GST (unless otherwise stated).
Delivery of Products & Services
It is your responsibility to ensure your device is technically suitable to download the Products prior to placing an Order. Desi Karandaglidis takes no responsibility where the Products fail to download to your device due to a technical error; and If you encounter a technical error in attempting to download the Products, please contact Desi Karandaglidis at desi.health20@gmail.com for assistance.
Cancellations & Refunds
Consultations and Programs (including masterclasses and courses) at Desi.K. health are non-transferrable.
Preparation for appointment
Technology – General
It is your responsibility to:
set up technology and ensure all appliances are charged and in working order;
set up the applications required on your phone or laptop to complete the consultation, this includes but is not limited to Zoom;
ensure you have a reliable and sufficient internet or phone connection or reception;
ensure any other technology related requirements (hardware or software) are available and in working order prior to the appointment;
Failure to follow these instructions may result in forfeiture of your appointment time and fee.
Technology – Zoom Appointments (both Australian Domestic and International)
A Zoom meeting will automatically be created when an appointment(s), is scheduled. It is your responsibility to ensure it is downloaded and tested prior to your appointment(s). If you are unable to access Zoom for your appointment, please email desi.health20@gmail.com and alternate arrangements can be made. Failure to follow these instructions may result in forfeiture of your appointment time and fee. For Zoom meetings you will receive the appointment link at the time of booking, this is also located in reminder emails and it is your responsibility to attend this at your appointment time.
Time Zone Differences
All appointments are made and will transpire using the Australian Eastern Daylight Time Zone (UTC +11:00). If you do not reside in this time zone, it is your responsibility to ensure you select the correct time zone in the booking tool and accurately convert the time change so as to not miss your appointment(s). http://www.timeanddate.com/ Failure to ensure an accurate time zone conversion will result in forfeiture of your appointment time and fee.
Governing Law
The validity, interpretation and construction of this Agreement shall be governed and construed in accordance with the laws of the State of Victoria, Australia with the sole jurisdiction and venue of any dispute being Melbourne, Victoria . The Client further agrees to be bound by the laws in Victoria even if the country’s laws in which the Client resides are in conflict with the laws of Victoria in accordance with the Hague Act and related statutes.

These terms and conditions are to be read in conjunction with our Privacy Policy as well as the Informed Consent and Disclaimer signed before becoming a Client.
Intellectual Property
The Intellectual Property in the Website and all Content (“Website IP”) and Products (“Products IP”) is exclusively owned and controlled by Desi.K. Health and our third party affiliates, licensors and/or licensees and is protected by Australian and international law governing intellectual property rights. The Website IP and Products IP remains Desi.K. Health ’s exclusive property throughout the world in perpetuity. You are not permitted to save, download, reproduce, display, copy, alter, conceal, adapt, perform, transmit, broadcast, sell, license or otherwise exploit any Website IP unless you have the express prior written authorisation of Desi Karandaglidis.
For Products and client resources purchased via the Website or emailed to you (the client or customer), you will have a non-exclusive, non-transferrable and non-assignable right to view and use the Products, and for Products obtained through digital download via the Website, display one copy of the Products on a device of your choosing, for private, domestic and non-commercial purposes only.
Liability
Subject to the application of any Non Excludable Conditions, Users hereby release Desi.K. health from all claims and Desi.K. health is not responsible nor liable for any injury, illness, direct or indirect damage, loss (financial, reputation or otherwise) or consequential, exemplary or aggravated damages arising from:
your use of, or inability to use, the Website;
your use of, or reliance on, the Products, Services or Content;
any User Content that is created, or otherwise appears, via the Website;
any failure by Desi.K. health offor other third parties to provide any information, service, feature or functionality via the Website; and
your use of third-party services (including any sharing to third-party websites) in conjunction with the Website.
Users hereby acknowledge and confirm that they are on notice of Desi.K. health’s disclaimer of warranties and limitation of liability set forth in this clause or elsewhere in these Terms and Conditions (“Disclaimers & Limitations”) and expressly agree to these Disclaimers and Limitations as a condition of using the Website.
Important Notes
Desi Karandaglidis is not a medical doctor and does not service medical emergencies or diagnosis. The Products, Services and Content must not be used or relied on as a substitute for medical, healthcare or other relevant professional advice, or for the purpose of diagnosis or treatment of any medical condition.
